Frequently asked questions

Under English law, you can apply for a divorce once you have been married for at least 1 year. Ending a marriage can be painful and challenging. You may find yourself fighting more with your spouse about property, money and family, than ever before. Our professional family and divorce lawyers will help you get through these difficult times whilst safeguarding your legal rights.

No. Since the introduction of no-fault divorce in England and Wales on 6 April 2022, you no longer need to prove fault or provide detailed reasons for the breakdown of your marriage. You (or you and your spouse jointly) simply need to provide a statement confirming that the marriage has broken down irretrievably.

The process now involves a minimum 20-week reflection period between the application and the conditional order, followed by a further 6 weeks before the final order can be applied for, which legally ends the marriage.

Our expert family and divorce lawyers will explain the process and help determine the best course of action for your circumstances.

According to our family and divorce lawyers, the duration of divorce proceedings varies and depends on the circumstances of each case. Under the no-fault divorce process, the minimum timeframe is around 6 to 7 months (a 20-week reflection period followed by a further 6 weeks before the final order), but the process can take longer where there are related financial or children matters to resolve.

Even if you married overseas, the courts of England and Wales may still have jurisdiction to deal with your divorce. Broadly, either you or your spouse must be:

  1. Habitually resident in England and Wales;
  2. Domiciled in England and Wales; or
  3. Last habitually resident together in England and Wales, provided one of you still lives there.

Consult our expert family and divorce lawyers so they can help you navigate through the divorce process and provide practical solutions for issues arising from your case.
